It’s not a very Happy New Year 2017 for the businesses in the Panvel Municipal Limits. The Panvel Municipal Corporation vide it’s GR Dt. 29th December 2016, has decided to levy the Local Body Tax on all Use, Consumption and Sale happening in it's territories. <br /><br />The schedule of rates has also been prescribed by the local body ranging from 0.5% to 8% depending on the commodities one is dealing in. Having said that, most of the commodities shall be hit at 1% flat rate.<br /><br />Although no clarification regarding the limit of turnover for one to get covered in the LBT is mentioned in the above GR issued, the same shall be prescribed to be Rs. 50 Crores and above as per what the Municipal Corporation of Navi Mumbai has done. <br /><br />This means large factories, warehouses, trading zones, etc established in Panvel and connected areas of the Taluka of Panvel like Taloja, Javahar Industries and even Panvel Industries, set up by corporates or multinational companies wherein the goods move inside the territory of Panvel shall and having the turnover to be prescribed soon shall get hit. <br /><br />This has to be done on basis of the value of the material moving into the territory in any form and hence even keen track of branch transfers from it’s own warehoused located out of Panvel. <br /><br />This may result in the increase in rates of automobiles which were cheaper as compared to new Mumbai due to LBT being present in Navi Mumbai, even housing and commodities of daily consumption like cooking gas & CNG as well to the extent of charge of LBT on the same. <br /><br />These dealers falling in the net of LBT, shall be required to take one more registration, pay taxes and also file returns with the local body in this regard in the periodicity prescribed.</div>

I recently launched an android app on google play store, which helps you manage all your dues. Think of it as an app to record all the credit purchases / sales and payment / receipt.<br>

Current Problem: </h3>
When businessmen sit down for settling their account (i.e. dues), almost every time they have a dispute on the amount due. This happens because one of them may have either missed recording of a transaction or recorded transaction with a wrong amount.<br>

Solution</h3>
If the person with whom the transaction is entered is notified about the transaction, then there will be no errors in the recording of transactions, i.e. synced accounting.<br>

How Counting Dues implements the solution</h3>
When a seller enters a sale transaction, the customer automatically gets notified to record a purchase transaction. When the customer makes payment and enters the same in the app, the seller gets a notification to record a receipt. In simple terms, when one party records a transaction, another party gets a notification to record opposite transaction.<br>

<span style="font-family: Verdana,sans-serif;">Despite giving assurance of complete abolition of local body tax (LBT) in the municipal corporation area from August 1, the state government has issued a notification that has only waived off LBT for traders with an annual turnover of less than Rs 50 crore.<br><br>The tax will continue to be levied for traders with business of more than Rs 50 crore.<br><br>In a notification dated July 23, the state government said that the traders with more than Rs 50 crore of annual turnover needed to register themselves with the civic body while those with a turnover of less than Rs 50 crore should apply to civic body for removing their names from the list of taxpayers. <li><span style="font-family: Verdana,sans-serif;">No tax, interest or penalty will be charged after 31st Dec 2015. </span></li>
<li><span style="font-family: Verdana,sans-serif;">Only 10% of the assessee will be assessed </span></li>
<li><span style="font-family: Verdana,sans-serif;">All assessment will be completed by 31st Dec 2015 (i.e. in just 5 months - Aug to Dec)</span></li>
<li><span style="font-family: Verdana,sans-serif;">If in amnesty scheme also dealer fails to disclose and pay LBT upto 10%, no interest and penalty will be charged.</span></li>

<span style="font-family: Verdana,sans-serif;">Because of these provisions in Amnesty Scheme, Municipal Corporations had written to the Urban Development Department to make changes. Specially Nagpur Municipal Corporation had raised their concerns over the provisions of the Amnesty Scheme could be misused and Corporations will have to bear losses. Already the Corporations are worried on the falling collections and LBT being withdrawn from 1st August*.</span><br>

These Acts never gave satisfaction to anybody, either it may be Revenue, Dealers or Courts of Law. Though not sure, but at least as on today, trading community is happy on the news that L.B.T. will be repealed from 01/08/2015. Of Course, as usual, alternative is un assured. Let us wait for the good to happen.<br><br>There are some provisions in the Maharashtra Municipal Provincial Rules of which proper care should be taken before repealing the Act.</span><br>

<span style="font-family: Verdana,sans-serif;">We saw the above screen flashing every 5 minutes in almost all all news channel on the day Maharashtra State budget was read by State Finance minister. We all were happy. Specially the trader community had more reasons to celebrate than others. The post here today is about will LBT go away so easily? Will NO LBT from 1st August 2015 be a reality? If it becomes reality what will be the consequence? </span><br>

<h3 style="text-align: left;">
<span style="font-family: Verdana,sans-serif;">Why this time the promise of abolishing LBT seems more promising than other past so many promises?</span></h3>
<span style="font-family: Verdana,sans-serif;">The answer lies in the place where the promise was made. The main reason behind government not being able to keep it's words for abolishing LBT was for lack of funds to substitute revenue which will be forgone by removing LBT. But, when the government sat down for making budget, they made through calculation of from where and how the forgone revenue will come from (which we will discuss in next para in this post). Thus when the promise of "No LBT" made in budget announcement, it seemed more promising.</span><br>

<h3 style="text-align: left;">
<span style="font-family: Verdana,sans-serif;">Effects of Abolishing LBT</span></h3>
<span style="font-family: Verdana,sans-serif;">The revenue loss by removing LBT will be compensated by adding a surcharge (in line with Gujrat) on VAT. In addition to increase in VAT, Property taxes, Water Tax may also be increased. The state government's move to bow down to the demands of traders and scrap the local body tax (LBT) may eventually burden people with hikes in municipal taxes such as property tax and water charges, in its bid to make up for the shortfall in revenue. The government is considering allowing municipal corporations to increase the taxes on civic services, such as water supply and sewerage system.<br><br>In his budget speech, <a href="http://en.wikipedia.org/wiki/Sudhir_Mungantiwar" target="_blank">finance minister Sudhir Mungantiwar</a> announced that the faith-based LBT, which replaced octroi in all of the state's municipal corporations except Mumbai, would be scrapped from August 1. He added that extensive deliberations were required before enhancing the value added tax (VAT) rates, indicating that the task is yet unfinished.</span><br>

<span style="font-family: Verdana,sans-serif;">The political side of LBT abolition.</span></h3>
<span style="font-family: Verdana,sans-serif;">When Cong-NCP alliance ruled Maharashtra, they argued that LBT cannot be abolished and included in VAT because surcharge on VAT will also be borne by villagers and people not in Municipal corporations. Logically speaking, LBT is an extra tax for enjoying facilities of living in Municipal Corporation. Hence, the logic given by then ruling party seemed logical. <span style="font-family: Verdana,sans-serif;">While the Octroi is set to go by March next year, the Mumbaikars will have to brace for a slew of additional taxes that Brihanmumbai Municipal Corporation (BMC) controlled by Shiv Sena-BJP combine will collect from 2016. Though no new taxes have been announced for this year, the municipal commissioner Sitaram Kunte has said that the BMC will be compelled to enhance the existing taxes or introduce new taxes in the years to come if the Octroi is abolished.<br />BMC. Reuters image<br /><br />The total size of the budget estimates, which was presented before the civic standing committee on Wednesday, for 2015-16 is Rs 33,514 crore which is 27.25 percent higher than last year’s budget of Rs 31,178 crore. The budget of the civic body, believed to be the richest civic body in Asia, is larger than many small Indian state government budgets including Goa, Himachal Pradesh, Utttarakhad, Manipur, Arunachal Pradesh and others.<br /><br />"The revenue from Octroi is the main source of revenue. It is estimated to be around Rs 7,900 crore which is about 41.03 percent. Thus Octroi continues to be the prime revenue source of the BMC. Octroi is a liquid source of income. Cash is collected daily which is used as a working capital to run the day-to-day affairs of the BMC. The main features of Octroi are liquidity and buoyancy which enables us to maintain cash flow and keeps us economically self-dependent," Kunte said in his statement spelling out the importance of Octroi for the BMC’s coffers.<br /><br />Kunte further stated that the abolition of Octroi, which has played crucial factor in budgetary planning since last several years, will adversely impact the revenue of the BMC. “The BMC may be compelled to enhance the existing taxes or introduce new taxes in the years to come. The new taxes like property tax, transport cess, conservancy cess and fire cess may be some of the available alternatives for augmenting the BMC’s future revenue and capital expenditure requirements,” he said.<br /><br />The Union Government has introduced 122nd Constitutional Amendments Bill in the Loksabha on 19th December, 2014 to facilitate the introduction of the Goods and Services Tax (GST) regime in India. GST will replace all indirect taxes levied on goods and services by the Central and State Governments. The amendment bill seeks to omit Entry 52 of the State List of the Constitution of India which empowers the Municipal Corporation to levy Octroi/LBT. Once this amendment is enacted, the powers given to Municipal Corporations to levy octroi will not be in existence.<br /><br />Due to implementation of the GST, additional tax will be assigned to States from where the supply of goods originates. However, there is no clarity yet on the mechanism to offset the revenue loss experienced by ULBs like Mumbai, Kunte said. The Centre is likely to reimburse the state with the difference in the revenue once it is implemented.<br /><br />The BMC’s ambitious coastal road project was the only big ticket infrastructure project in the civic body’s budget. Since the project yet to get green clearances, it has set aside only Rs. 200 crore for the project this year.<br /><br /> </span><br />
<span style="font-family: Verdana,sans-serif;">Interestingly, the budget had several schemes that take a leaf out of Prime Minister Narendra Modi’s schemes. From Modi’s pet Swaccha Bharat Abhiyan and Beti Bachao Beti Padhao scheme to his ‘ease of doing business’ initiative, the smart city project and Digital India policy, Kunte adopted several of the PM’s flagship schemes for the city. In a bid to promote industry and in tune with Modi’s bid to fast track clearances to industrial projects, BMC has set up an in house Business Development Department to increase the ‘ease of doing’ business in the city.<br /><br />Development of roads, open and cultural spaces and gardens in the city dominated the budget as the civic body has set aside Rs. 3200.25 crores for construction and repairs of roads and bridges in the city. Apart from roads, the BMC has allocated a lot of funds for the development of open spaces and gardens in the city.<br /><br />In a bid to improve quality of slums, Kunte has set aside Rs. 8471 crore for extension of services to the urban poor. Under this scheme, slums will be upgraded in a systematic manner. BMC has decided macro and micro level planning for slum improvement. However, at the same time, it has also proposed taxing slums. “We are studying the feasibility of levying and recovering property tax on hutments in slums,” Kunte said.</span><br />

This bill shall lay foundation for GST, as it shall make changes in taxation lists i.e. - Union, State, Concurrent list to provide for a unified single indirect taxation.</span><br />

<span style="font-family: Verdana,sans-serif;">It is true that one cannot break the law, irrespective of his or her position or influence, and if it is broken, one should be held responsible for it, and for that purpose, one could be punished in connection with severity of the crime, but if the law itself is made against the human rights and responsibility, then ?.The endeavor of the government to collect the revenue through the legal arrangements was started by the Roman empire and had named it as ‘Octroi’ for the first time, which was later adopted by the world, and we too, followed it ! </span><br>

But two years back, the State decided to phase out Octroi and phase in Local Body Tax, which was not happy ending of the problems. In 1987, a Committee under Maharashtra’s former Chief Secretary, Shri P.D. Kasbekar had recommended a Local Body tax, in place of Octroi. After various committee meetings and about several years of deliberating, Maharashtra has finally decided to implement LBT in some Corporations phase wise. Why this new law was made forceful this much late ?The reason, it was not suitable !

Octroi is a one time tax imposed on entry of all goods, but it has some difficulties too. Under LBT, traders and manufacturers are required to keep their monthly record. There are other taxes existing like Excise Service Tax, VAT etc. including LBT, and now GST has also started peeping in. Currently, the protest against Local Body Tax has increased in a very severe manner.This reflection is due to feeling of harassment to the traders.</span><br>

Over the last decade, all States except Maharashtra have replaced octroi by other taxes, e.g. Tamil Nadu, it fixed flat 2 % rate, and it also restored it. Gujarat abolished octroi and instead hiked VAT rates by 1 percent. The octroi was simple in procedure to be followed, where as in LBT, though it is an alternative to octroi, the heavy compliance is amounting to complication, therefore, LBT too, is lacking the cent percent.

<span style="font-family: Verdana,sans-serif;"><br><br><span style="font-size: small;">No end in sight to local tax issue as alternatives - turnover & entry tax cut no ice with biz-men Maharashtra Chief Minister Devendra Fadnavis' effort to find a compromise solution to the local body tax (LBT) seems to have again run into a wall with the traders' body showing little interest with the options offered by the new CM.</span><br><br>Fadnavis had said that his government would withdraw LBT soon and that a `solution' is in the `final stages' even as it held out two options -turnover tax and entry tax. Both options, however, failed to cut much ice with the traders.<br><br>Mohan Gurnani, president of the Federation of Associations of Maharashtra (FAM) that is negotiating with the state government on behalf of the traders’ body, said they were not happy with the options.<br><br>“The turnover tax is more draconian than LBT. For instance, under this, if a manufacturer sells a match box to a wholesale dealer, then he would have to pay a turnover tax, while the wholesaler would also have to pay a tax if he sells the match box to a semi-wholesale dealer, and the latter would have to pay the same tax if he sells it to a retailer. The retailer would also have to pay a turnover tax if he sells it to a customer. This would lead to a cascading effect on the prices and is not at all workable,” Gurnani claimed.<br><br>The traders are also opposed to the entry tax, which Gurnani claimed is just another form of octroi. “It’s basically an other form of octroi called the entry tax whereby goods coming in the jurisdiction of a municipal corporation or council limits have to pay tax. We oppose this as it is just another form of levying octroi which we have opposed,“ he added.</span><br>

<span style="font-family: Verdana,sans-serif;">The BJP in Maharashtra had declared before the assembly elections in the state that Local Body Tax or LBT would be removed if they came to power in the state, however now it's clear that despite ·the BJP taking charge of the government it will not be removed. State finance minister Sudhir Mungantiwar said on Thursday that LBT will stay in Maharashtra till General Goods and Services Tax (GST) regime is introduced by the Centre. Traders in Maharashtra had launched several agitations against the Congress-NCP government in the state in the last one or two years to oppose LBT and specially the system of the collection of this tax.</span><br>

<span style="font-family: Verdana,sans-serif;"><br />At a meeting with the traders on Wednesday, Fadnavis said his government was committed towards ensuring a transparent taxation system for them.<br /><br />According to president of the Federation of Association of Merchants (FAM), which had spearheaded the agitation against LBT, Fadnavis was very positive about resolving the issue.<br /><br />The traders have been demanding that octroi as well as the LBT system be scrapped, and additional cess be collected instead, based on the sales tax collection.</span><br />

<b><span style="font-family: Verdana,sans-serif;"><br></span></b>
<b><span style="font-family: Verdana,sans-serif;">Let's have a brief introduction to LBT Problem.</span></b><br>
<span style="font-family: Verdana,sans-serif;">Industrialist were not happy with Octroi, as whenever the goods used to be imported into the city, it was assessed at the Naka and Octroi was paid. Then there is infamous corruption. Traders were also not happy, but Industrialist were furious. By traders, I mean those who were importing goods once in a month or quarter. Few of the traders were not coming under the Octroi net as they used to carry the goods with them and hence bypassing the Naka. By </span><span style="font-family: Verdana,sans-serif;">Industrialist, I mean those who used to import goods on a daily basis and were being harassed by Octroi officers on almost daily basis.</span><br>
<br>
<span style="font-family: Verdana,sans-serif;">This all lead to voice for a taxation system which removes Naka. Thus the introduction of LBT. Industrialist were happy that this will reduce the harrasment and also the goods movement will be faster. But the traders were irritated as they will have another department to take care and also will need to have a complex and complete accounting of all goods purchased and sold. Talking about the "few traders" </span><br>
<br>
<span style="font-family: Verdana,sans-serif;">LBT was supposed to be a simple entry based taxation where we would have a single rate of tax (or a 2 rates system max). But this expectation were crushed as soon as the government came out with rate schedule. To further agitate the business community, the rate schedule was different for all corporation. To even further complicate the situation, the LBT rules were not drafted properly. The LBT rules (which effectively is LBT Act) had many interpretation and thus complex to understand. The problem doesn't stopped here. The Octroi department was shifted to manage the LBT department without proper training in many of the corporations which added to the complexities. </span><br>
<span style="font-family: Verdana,sans-serif;">Thus we had a LBT problem. We all needed the LBT to go. </span><br>
<span style="font-family: Verdana,sans-serif;"><br></span>
<b><span style="font-family: Verdana,sans-serif;">Let's now discuss, the present situation and then the solutions to LBT Problems.</span></b><br>
<span style="font-family: Verdana,sans-serif;">Since BJP has already promised the traders to remove LBT from Maharashtra. Shiv Sena has also made a similar promise. So, on the assumption that these promises shall be kept, the LBT will have to be scrapped. But the solution to the problem is not so simple. The government will have to think as to how will this gap of funds be filled up and by which Tax. </span><br>

<span style="font-family: Verdana,sans-serif;">Municipal corporations have already told state government that, the corporations will need some tax or another in place of LBT. Considering the fact that in most of the corporations the collections from LBT has been less that what was the collection under Octroi. </span><br>
<span style="font-family: Verdana,sans-serif;"><br></span>
<b><span style="font-family: Verdana,sans-serif;">Let's now discuss, the solutions to LBT Problem</span></b><br>
<u><span style="font-family: Verdana,sans-serif;">1st Solution - Increase VAT (i.e. LBT collected by adding it to VAT)</span></u><br>
<span style="font-family: Verdana,sans-serif;">This is the most discussed solution to LBT Problem. Also this is the favorite of Traders. Here the proposal is to increase VAT rate and the VAT collected on account of this increased rate of VAT shall be distributed to corporations. It has following Positive points</span><br>
<ul style="text-align: left;">
<li><span style="font-family: Verdana,sans-serif;">Reduces one department for businessmen, thereby reducing compliance (not to mention corruption)</span></li>
<li><span style="font-family: Verdana,sans-serif;">Ease in doing business</span></li>
<li><span style="font-family: Verdana,sans-serif;">No fuss of accounting, which is required in LBT</span></li>
