A Writ Petition was filled in Bombay High Court

The challenge in this Petition under Article 226 of the Constitution of India is to the provisions of certain Rules incorporated in the Bombay Provincial Municipal Corporations (Local Body Tax) Rules, 2010. In the entire Petition, admittedly there is no averment that any recovery is sought to be made against the Petitioners relying upon the said Rules.
There is no averment showing as to how the Petitioners are materially affected by the said Rules. Admittedly, as of today, no recovery is sought to be made against the Petitioners of local body tax. Therefore, at this stage, at the instance of the Petitioners, the present Petition need not be entertained and the same is disposed of.
